These Terms of Service are entered into by and between you and Vybes App, Inc. (the "Company," "Vybes," "we," "our," or "us" as the context may require). The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, "Terms of Service," or "Terms"), govern your access to and use of our websites, any of our mobile applications, or any of our other services, including any content, functionality, and services offered on or through the Services including, but not limited to, events and other in-person interactions (collectively, the "Services").
Please read the Terms of Service carefully before you start to use, engage, or participate in any of the Services, including applying to the Services. By using the Services, or otherwise accessing, installing, applying or participating in them, you accept and agree to be bound and abide by our Terms of Service and our Privacy Policy ("Privacy Policy"), located on our website and mobile application and incorporated herein by reference. If you do not want to agree to these Terms of Service, the Privacy Policy, or any other terms applicable to you, you must not access, use, or participate in any of the Services.
By using the Services, you represent and warrant that: (a) you are of legal age in your country and at least 18 years old; (b) you have not previously been suspended or removed from any of the Services; and (c) your registration and your use of any of the Services is in compliance with any and all applicable laws and regulations.
We may revise and update these Terms of Service from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to, use of, and participation in the Services thereafter. Your continued use of or participation in the Services following the posting of revised Terms of Service means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you. You should also carefully review our Privacy Policy before using or accessing the Services.
THIS DOCUMENT CONTAINS VERY IMPORTANT INFORMATION REGARDING YOUR RIGHTS AND OBLIGATIONS, AS WELL AS CONDITIONS, LIMITATIONS, AND EXCLUSIONS THAT MIGHT APPLY TO YOU. PLEASE READ IT CAREFULLY.
THESE TERMS REQUIRE THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS.
Notice to California Subscribers:
You may cancel your subscription, without penalty or obligation, at any time prior to midnight of the third business day following the date you subscribed. If you subscribed using a Third-Party Platform (e.g., Apple ID, Google Play), you must cancel through such Third-Party Service. If you subscribed through your Apple ID, refunds are handled by Apple, not Vybes. You can request a refund from Apple through your Apple ID account on your phone or at https://getsupport.apple.com. All other users may request a refund by contacting Vybes at info@vybes.co.
1. ACCESSING THE SERVICES AND ACCOUNT SECURITY
1.1. Membership
Access to our Services is limited to individuals who have either submitted an application for membership and have received approval from the Company or received a direct invite from the Company to join our membership community. We reserve the right to verify identity, background, and other credentials before granting access. If you fail to verify your identity, you may not be able to access the Services or you may lose access to the Services.
1.2. Eligibility
By using, accessing, or participating in the Services, including applying or accepting an invite to use the Services, you represent and warrant that: (a) you are of legal age in your country and at least 18 years old; (b) you have not previously been suspended or removed from any of the Services; (c) your registration and your use of any of the Services is in compliance with any and all applicable laws and regulations; (d) you have not committed, been convicted of, or pled no contest to a felony or indictable offense (or crime of similar severity), a sex crime, or any crime involving violence or a threat of violence; and (e) you are not required to register as a sex offender with any state, federal or local sex offender registry.
1.3. Account Security
You must treat your username, password, and any other piece of security information as confidential. You agree to notify us immediately of any unauthorized access to or use of your username or password.
2. USER CONTENT
The Services contain certain interactive features that allow users to post, submit, publish, display, or transmit content to other users. All User Content must comply with our Content Standards and Community Guidelines.
3. PAYMENT TERMS
Some Services require payment. All purchases may be made through Third-Party Platforms or directly through us. All prices are subject to change without notice. Subscription services will automatically renew unless canceled before the renewal date.
4. INTELLECTUAL PROPERTY
The Services and their entire contents are owned by the Company and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
5. SAFETY WARNINGS
YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS. WE DO NOT GUARANTEE YOUR SAFETY.
YOU AGREE TO USE CAUTION AND EXERCISE GOOD JUDGMENT WHEN INTERACTING WITH OTHER USERS, WHETHER THROUGH THE SERVICES OR IN PERSON. VYBES IS NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER ON OR OFF THE SERVICES.
6. DISCLAIMER OF WARRANTIES
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
7. LIMITATION ON LIABILITY
TO THE FULLEST EXTENT PROVIDED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR MAXIMUM LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
8. DISPUTE RESOLUTION AND ARBITRATION
ANY CLAIM OR DISPUTE BETWEEN YOU AND US WILL BE RESOLVED THROUGH BINDING ARBITRATION, RATHER THAN IN COURT. YOU WAIVE THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

If you are located outside the United States, your data will be transferred to and processed in the U.S. By using Vybes, you acknowledge and consent to this transfer.
8. DATA RETENTION
We retain your data only as long as necessary for legitimate business purposes or as required by law. Some data (e.g., moderation logs, incident reports) may be retained longer to prevent abuse or comply with legal obligations.
9. CHILDREN'S PRIVACY
